WAO's February 2012 Operations Report

Again, last month's WAO operating report was very interesting. Not as bad as the last couple of months, but still interesting, never-the-less.

You'll notice at the bottom of  page 2, the WAO spent more than it took in for this month. Whoop whoop.  

Fuel purchase is still high considering that there are only monkeys and ferals living on the land now, but heck, that's nothing new, now is it?

It is my understanding the USDA has been on the property, testing the animals as part of an agreement with Born Free to accept the animals.  So, you'll notice, the cost of fruits and vegetables went up for the first time in a while! Finally, donations going towards the animals! 

I'm curious as to what was purchased at  Wal-mart, the Dollar Store, Academy, and the gas station convenience store, Sac n Pac.  "Supplies for Talley?"  What kind of "supplies" does one buy for the monkeys at a convenience gas store, for instance, in San Marcos?!

And then there were the two vet bills paid this month.  Would not surprise me in the least that the USDA insisted on one or more monkeys be seen by a vet due to a serious health condition.  Vet bill payments are rare on these monthly operations report.

Oh , heck, vet treatment was rare at the WAO, period!

At least we know there are still ferals living at Talley Road--unless of course the cat food purchased is for some one's private pet.  I just pray someone will save these wild cats before everyone pulls out of Talley Road.

I'm Missing Former WAO Tigers Now Living at WCS

While I was reseaching my last posting, I found these pictures of Leyla, Zeus, Sierra, and Eketrina (but none of the former WAO bobcats) on WCS' Facebook page.  The tigers look so happy!









I pray the live long and happy lives at Wild Cat Sanctuary.

Dear

I'm trying to raise $25,000 by March 26th to help move two big cats and build a proper new enclosure for a beautiful white tigress.

Nikita is the white tigress, and she and Tasha the cougar were each raised under cruel and sorrowful circumstances. They are currently restricted to a tiny enclosure in Ohio.

With your help, we'll be able to move them to beautiful and spacious Wildcat Sanctuary in Sandstone, Minnesota. And we'll be able to build a wonderful new enclosure for Nikita.

The Wildcat Sanctuary will allow them to live out the rest of their lives in an enriching and humane setting.

Can you please help?

March 26th is next Monday - that doesn't leave much time but if ever two wild animals needed and deserved our immediate help, it's Nikita and Tasha.

Nikita's sad story starts as many captive big cats stories do. As a cub she was used as a photo prop - but as soon as she became too big, she was used to breed more tiger cubs also used as photo props.

Tasha's early life was miserable as well. She lived in a garage for nine years – nine years! - and was forced to breed repeatedly. One day she escaped, but with no skills to survive on her own, she soon returned, scared and hungry.

Each cat currently lives in a cramped 10' x 10' enclosure. At the Wildlife Sanctuary, they will be free to roam an 8,000 foot area, complete with the tall grass they love to run through, trees to stretch up and scratch their claws on, a pool to cool off in, and access to an indoor, temperature-controlled den.

And they'll finally have expert veterinary care and the undivided attention of devoted caregivers.

Of course, big cats should never be kept in backyards or garages, and IFAW is leading efforts to pass the Big Cats bill that will prohibit the ownership of big cats except by accredited facilities like the Wildcat Sanctuary.

Nikita and Tasha have never known what it feels like to be free, to roam around as big cats like to do.

Please help us move Nikita and Tasha and build a spacious new enclosure.

You'll be giving these two deserving cats a new start in a forever home where they can live out their lives in a natural setting. And you'll be helping IFAW's mission to rescue, care for, and protect animals around the world.

Did you know, from reading his e-news appeal, that the cats are already scheduled to arrive at WCS early next week?  It's already been arranged.  Shame on IFAW for making up a false deadline encouraging folks to donate funds ("March 26th is next Monday - that doesn't leave much time but if ever two wild animals needed and deserved our immediate help, it's Nikita and Tasha."), making it sound like if people don't donate right now, right this very second, the consequence could be...what?

An Ohio exotic animal owner is sending two big cats to Minnesota ahead of stricter rules in her state.

A tiger and a cougar will arrive at The Wildcat Sanctuary in Sandstone, Minn., next week after their owner contacted the sanctuary for help. The animals, Nikita and Tasha, will join the more than 120 wild cats already living on the Sandstone property.

Lawmakers in Ohio and in Congress are proposing tougher regulations on private ownership of exotic animals following the release of dozens of animals in October by an Ohio man who then killed himself.

Here's where it gets weird.  Does WCS plan to place one cougar in a 8,000 feet enclosure by herself, as pictured above (which by the way, where are the trees and the pool??  They all must be behind the photographer! Or will she tossed in with the other cougars living on the property?).
And I guess that mean WCS plans on building the white tiger her own enclosure -- another 8,000 square foot cage just for her?

Wow, no mention that the female owner voluntary relinquished her cougar and tiger.  The way IFAW writes about the animals' previous life experiences, she must be a really horrible person, right? Let's look at WCS Razoo project page to find out:

"We received a tearful call from an Ohio woman asking us to help her and her cats.
She is a USDA licensed owner who was committed to providing a home for her cats but realizes what the future will mean for her and the animals she has in small cages in her backyard. Though she’d like to provide more for these animals, she’s struggled financially to keep up and is fearful she can’t meet the regulations the new legislation will require. She researched different sanctuaries and contacted The Wildcat Sanctuary because she felt we could offer what her animals deserved – a home for life, where they wouldn’t be uprooted again and where they would have the open space she couldn’t provide for them."

As of today, $18,490 was raised out of $30,000 on their Razoo page.  With IFAW's donation of $25k added to the $18k+, I guess both animals will have pretty fantastic enclosures. Hmmm....Looks like this Razoo project has been in the making since the end of February! 
Now, don't get me wrong, I am not "slamming" Wild Cat Sanctuary.  In fact, as far as I can tell, they didn't do anything wrong in fundraising for the two cats. 

I'm merely pointing out how IFAW does not actually tell everyone the full story behind their little e-fundraising letters, nor do they solicit funds in what I would consider to be in an ethical manner.  They used the same, in my opinion, deceitful fundraising practices for the WAO tigers moving to Carolina Tiger Rescue.  I guess you can tell I'm not a fan of IFAW or the way they conduct business in the United States.  It's no wonder people are hesitant to donate funds--who knows if anyone is telling the truth anymore.  One shouldn't have to do this much investigating into a cause, just to find out that a large animal organization failed to get the entire story correct--all in the name of money.

We love the media coverage that has come with bringing Nikita and Tasha to TWS, but with it comes some inaccuracies. One station had announced that these were the Zanesville survivors and another mentioned they were pets. The truth is that this was a USDA licensed facility that was struggling with finances and pending legislation. The owner of the facility rescued Nikita nd Tasha from their horrific backgrounds. It was her selflessness that ensured they ended up at TWS! And we applaud her for that. She had the best interest of the animals at heart..

I had no idea the cats came from another rescue center!  IFAW NEVER mentioned this in their e-appeal letter!

My TX OAG Open Records Received this Month!

Well, I received my latest round of open records, and most of the information was either repeats of previous communications or information I already obtained from the bankrupcty court.  I did put together documents I felt were of interest to me:

I have been praying that the monkeys would be leaving the WAO this month.  Finding out that they may have to stay under the Cryers control for another two months is absolutely horrible.  I guess that means the Cryers will have more than ample opportunties to use the WAO's checkcard and checks for undocumented purchases. 

Meanwhile, Okemo's jaw is slowly deteriorating.  The In-Sync Exotics' staff is concerned he may fracture his jaw any time now.  More bone is collecting in his jaw, just like last month.  This is absolutely heartbreaking. 

So while Okemo is slowly dying, the Cryers are doing what exactly with the WAO money?

Why the OAG didn't follow-up on the CID submitted in 2010 is beyond me.  At least now, they are insisting they comply with the documentmented request.  Better late than never, huh?  Too bad the public will not be able to see the CID response.  I have no doubt, based on Cryer's poor track record in truth telling that the response will be full of whoppers!

I wonder if they (OAG attorneys) are going to insist they continue to post the WAO's operations report with the court.  Not surprisinly, last month's report still has not been filed with the court.  Whoop, whoop.

Looks like Born Free has started the enclosure construction:

March 22nd, 2012 Construction progress on the first of two four-pack enclosures for the primates from Wild Animal Orphanage in San Antonio, Texas. Each of the 4 sections is over 10,000 square feet. Crew is from Texas Purple Sage Services out of San Antonio.

I am concerned about the lack of mature trees that would provide shade for the monkeys.  Hopefully some trees will be brought in?

A Criminal Act to Expose Animal Abuse

Undercover videos showing grainy, sometimes shocking images of sick or injured livestock have become a favorite tool of animal rights organizations to expose what they consider illegal or inhumane treatment of animals.
These videos, made by animal rights advocates posing as farm workers, have prompted meat recalls, slaughterhouse closings, criminal convictions of employees and apologies from corporate executives assuring that the offending images are an aberration. Yeah, sure.
On March 2, 2012, Iowa Gov. Terry Branstad signed into law a bill designed to thwart activists who go undercover to report animal abuse. This makes Iowa the first state in the country to pass such a law; Illinois, Indiana, Minnesota, Missouri, Nebraska, New York and Utah are considering them to pre-emptively block the kind of investigations that have left their operations uncomfortably open to scrutiny.
This bill makes it a crime to produce, distribute or possess photos and video taken without permission at an agricultural facility. It would also criminalize lying on an application to work at an agriculture facility “with intent to commit an act not authorized by the owner.”
As a general rule, I believe that the property owners have rights and should not have to deal with people trying to hurt their business or industry. However, having said that, I truly believe we need investigators willing to expose the truth when it comes to the “animal industry.” So I wrote letters to my state senators.
Here is my first response. Tell me, you do you think she is for or against this topic?

Thank you for contacting me about a recent proposal involving the use of photography and videotape as a means to prevent illegal activities that cause food-borne illness and animal abuse at agriculture facilities.

I am aware that in states other than Texas there is proposed legislation to prevent individuals from videotaping or taking pictures at agriculture facilities. The legislation is to prevent unsolicited individuals from obtaining pictures or video without authorization. If a land owner or facility owner does not authorize individuals to take photos or video at the facility, that right should be respected. However, I do not condone animal abuse, illegal working conditions, or unsafe food processing because these cause serious public safety concerns. If an individual sees illegal activity occurring at an agriculture facility, he/she should report it to the Texas Department of Agriculture immediately.

If legislation that prosecutes illegal activity at agriculture facilities is introduced in 2013 during the 83rd Legislative Session, I will give it the same careful consideration that I give all bills. I will continue to support health and public safety in my future legislation actions.

Wow...my democratic elected official wants people to approach the Texas Dept of Ag with complaints of animal abuse (think USDA) and what? Hope they will do the right thing...oh right! I'm sure they are very aggressive against businesses that abuse animals and will immediately acts upon animal abuse complaints, just like the USDA did when I came forward with my "concerns" of WAO animal abuse allegations.

So, it's a terrorist act if one takes videos and pictures of lab animal being abused or treated cruelly and now its a criminal act to take videos and pictures of animal abuse/cruelty at animal farms. What next? Zoos? Sanctuaries? Pet stores? Theme parks? Race tracks?

I hate to say it, but pictures and videos speak volumes in comparison to a verbal or written complaints filed on behalf of the animals. If I didn't have all the undercover videos and pictures taken at the WAO, how in the world would I have been able to prove animals were missing (presumed dead) or on tour sick/dying?

Government doesn't care about what we have to say! They do care about how their actions or in actions will be perceived by the public and it has a tendency to act much quicker if the public is aware of a growing "concern," thereby demanding justice for the animals. Videos and pictures are a great tool in influencing government to do the right thing. Without these tools, how can one really prove abuse or cruelty is actually going on in an animal "business?"

I wish the WAO case had gotten wide media coverage. I can guarantee you this--this case would not STILL be on-going after six years. Six years, people. Six long years and counting.

Sad to say, when it comes to animals, the government and certain businesses cannot be counted on doing the right thing--whether those businesses be for profit or non-profit. It takes brave people to take a stand and photograph these kinds of illegal acts. It is never easy to ask anyone to volunteer and take videos/pictures, but in my opinion, it is often necessary. And so now in Iowa, it is a crime to save human and animal lives by exposing animal abuse & cruelty allegations. Figures. Just figures.

History Repeats Itself

Yesterday, I received word from a friend that what happened at the WAO is happening again at ASAP.  You may recall that ASAP, founded and operated by Carol Asvestas, was created after she QUIT the WAO in 2009.

Animal Shelter Assistance Program Inc. was founded by Carol in 2010 and is operated from her own home (note her home address above).  From what I understand, the 13 cats and 3 dogs live in metal cages (allegedly stolen from the WAO years ago) are located outdoors, rain or shine.  Apparently, there is quite a bit of feces piling up around the cages.  This is very reminiscent of when Carol first started a sanctuary with bears, wolves, a monkey.  The pictures from the "early years" was very disturbing.

I am told the animals are covered in fleas, no doubt infected with tapeworms, and are rarely allowed outside their enclosures because Carol "frowns" on letting them out of their cages.
I also heard that Carol has a copy of the WAO mailing list and is using it to solicit funds from folks she knows is sympathetic to her being "ousted" (as she tells it) from the WAO.  Organizations, such as the Tissue Foundation (donating around $2500 recently), is apparently paying for Carol Asvestas' bills such as county taxes for their personal homestead (heck the animals must pay rent for living on the property right?) and the electric bills (the animals benefit from the use of electricity, right? [wink wink]) Does any of this sound familiar?
It should, as Carol Asvestas pulled this same stunt as seen in the February 21, 2009 board meeting minutes, where she claimed that the "Katrina" rescue cats were housed in their personal house (yeah, right---NOT!) and that the WAO should pay "rent" for the animals along with the Asvestas' electricity (after all the cats needed A/C too...NOT!).  It was just another scam to get money out of the WAO, simply because the Asvestas' knew that their time at the WAO was coming to an end.
By my calculations, the Asvestas' are probably not  receiving unemployment checks from the government anymore as their time expired.  And no doubt Carol requires cash since she refuses to seek legal employment (after all who wants to hire an alleged thief!), and with the ASAP piggy bank so close at hand, I guess she has little fear that anyone from the OAG will touch her if she dipped into the dogs and cats' donated monies.  After all, they never stopped her from dipping into the WAO piggy bank, right?  Right.
So what is Carol's ASAP asking for on their wish list besides money?

At one time, Carol was asking for "land" on her wish list site, but I see now it has been removed (as according to her divorce paperwork she has land somewhere), along with the monkey chow.  Instead she's looking for the stuff listed above.  The sad thing is I've heard she's not even willing to use ASAP donated funds to buy dry dog and cat food for the animals on her property; instead relying on others to buy  food for the domestic animals, while she allegedly continues to spend the ASAP donated-funds on her personal expenses.
Why the heck didn't the OAG stop this nightmare from starting up all over again?  Have they no shame for putting more animals' lives at risk all over again.  I have lost all faith in the Texas OAG.  As far as I am concerned, they are Carol's enablers and she will never stop fundraising for animals that she has no intentions of saving; instead using them to raise money so she can live off their backs while they suffer in silence. 
Sickening.
Now the question is what do I do?  Do I get involved, try to save the dog and cats, or do I turn away, like so many other people have done so in the past?  I think you already know the answer to that question.

I am hoping for an opportunity to meet with you next week (Thursday or Friday) to discuss the growing problem of a local "domestic cat/dog shelter" called the Animal Shelter Assistance Program Inc. (A.S.A.P.) based here in San Antonio. A.S.A.P. was established by Carol Asvestas (also founder of the Wild Animal Orphanage) in 2010 and has been operating as a domestic animals shelter at her personal homestead (domestic animals are forced to live outdoors, rain or shine).
Plus, I am also very concerned with the ferals that may still be living at the Wild Animal Orphanage's Talley Road property, located in San Antonio. Very soon the last group of animals (non-human primates) shall be moving to Born Free, leaving the remaining ferals behind. Since the WAO's exhibitors USDA licence expires at the end of this month, and because the ferals are domestic and not exotic wild animals, Dr. Robert Gibbens of the USDA will not have the legal ability to ensure these animals are not left behind or needlessly destroyed when the WAO closes its doors forever at Talley Road.
I believe Jessica Saucedo may have given you an idea of the WAO feral cat situation and I am following up to find out whether or not the WAO ferals can be saved before they are destroyed/left behind.

As far as your meeting request, Thursday or Friday is fine. Tomorrow anytime before 12 or anytime after 330 is fine for me. Let me know what will work for you.
As I feared, Mr. Medley had no intention of taking any of my concerns seriously.  In government, when someone says "With all due respect" we are basically putting a person in "their place" -- you know, letting that person know they have more important issues to deal with than with you.  The minute I saw this second sentence, I knew this person did not have the ferals or the ASAP cats' well-being at heart.  He's just too busy to deal with this case.  Sounds familiar.  USDA and OAG didn't have the "time" to deal with the tragedy at the WAO.  And now Mr. Medley doesn't have the time to stop another tragedy from happening.

In order to update the San Antonio Animal Control Services department, I have provided a brief timeline of events outlining my concerns relating to the remaining WAO feral cats and the operation of A.S.A.P’s dog and cat shelter in San Antonio, Texas:
·I was the former WAO Vice President and Treasurer from 2004-2005;
·In 2006, I confronted the Board of Directors with allegations of misappropriation of funds and violations of the AWA;
·Board refused to address the allegations, so I voluntarily resigned from the WAO board of directors on 01.07.12;
·Filed formal complaints against WAO’s board of directors with the Texas OAG and USDA/APHIS;
·In 2009, Carol Asvestas and her spouse, Ron Asvestas voluntarily terminated their positions with the WAO;
oInexperienced board of directors did not accept their resignations, but instead placed them on administrative leave pending an investigation into their activities;
oBoard was forced to terminate both Asvestas’ for cause in Sept 2009;
oThe Asvestas’ received unemployment benefits up until 2012;
§Apparently, neither Carol Asvestas or her spouse have found legal employment;
·WAO ceased operations in 2010 and re-homed its exotic wild animals over the next two years;
·WAO at one time operated an illegal “Feral Cat Rehabilitation Center” at Talley Road (2000 - 2009);
oThere was no “center.” Cats were dumped at Talley Road and left to fend for themselves;
oCarol Asvestas received $200+ per feral cat that was released at the Talley Road facility;
oAccording to WAO’s own 2006 website, WAO took over 500 cats to the “Feral Cat Rehabilitation Center;"
§Former WAO employee reported that the majority of the feral died from exposure, lack of food, or were killed by the wild animals living on the property.
oIn 2011, it was reported that there were still 30 surviving ferals left living at Talley Road requiring placement;
oIn 2012, WAO refused assistance from Feral Cat Coalition, saying they would “keep them in mind” if they need help placing the cats;
oI have grave concerns that the remaining feral cats will be abandoned once the last non-human primates depart from the facility within the next two months;
§USDA/APHIS no longer has jurisdiction over the WAO animals as WAO relinquished its exhibit license;
§WAO has a terrible track record of protecting feral cats in its possession.
·Carol Asvestas started animal shelter called >Animal Shelter Assistance Program Inc. (A.S.A.P.);
oA.S.A.P. was established in January 2010 as a 501(c)3 nonprofit organization;

oA.S.A.P. operates a dog and cat shelter (approximately 23 animals thus far) at Carol Asvestas’ personal residence located at 9488 Leslie Road, San Antonio, TX 78254.

§Caller-id displays A.S.A.P. telephone number as “Animal Shelter”;
oA witness came forward alleging that Ms. Asvestas is actively fundraising for the animals, receiving thousands of dollars that are supposed to go towards animal care;
§Ms. Asvestas allegedly uses the donated funds to pay for her land taxes which is currently in arrears and to pay for her electric bills;
·Ms. Asvestas allegedly claimed the “shelter” owes her “rent” plus the cost of electricity to maintain the animals' comfort level (please note, there are allegedly no heaters or A/C in the enclosures).
·For OAG: This may sound familiar as Ms. Asvestas made a similar fraudulent claim that the WAO owed her monies for several months’ worth home mortgage payments (even though the Asvestas no longer paid a mortgage after fulfilling the note requirements) for housing the hurricane cats in her home and the cost of electricity (see WAO Board of Directors meeting minutes for February 2009);
·According to a witness, the shelter dogs and cats are allegedly covered in fleas and have shown signs of having worms;
oVet care allegedly not provided;
oNo regular employee or volunteer provides care to the animals;
§Two volunteers allegedly try to care for the animals on a daily basis if their schedule permits;
oDespite receiving funds from donors, purchases of dog and cat food are allegedly made by others, like the volunteers, when they can afford the food;
oDogs are housed together in one cage—cats are housed together in another cage;
oCarol Asvestas allegedly “frowns” on letting the dogs exercise outside their cage;
oAnimals are allegedly left on their own except during brief feeding and occasional cage cleaning visits;
oAnimals allegedly escapes inclement weather by going into dog “igloos” set-up by the volunteers;
Mr. Medley: Unfortunately, the times you provided to me for tomorrow’s meeting will not work as I already have scheduled appointments for the entire day that cannot be changed at this late date. Therefore, I respectfully request that ACS accept this formal comlaint and to make a “home visit” to this alleged dog and cat shelter to determine the health and welfare of the animals. My concern is that Ms. Asvestas’ may be operating an illegal domestic animal shelter from her personal residence. I believe this falls under your jurisdiction since A.S.A.P is not breeding or exhibiting any wild animals on her property.
I also respectively request the Texas OAG to consider this another formal request to investigate the activities of Carol Asvestas, owner and operator of A.S.A.P., to determine if, once again, she may be misappropriating funds from a non-profit charity.

Joan is Shut Out Again

While I am not a "fan" of Joan Bryon-Marasek because of the nasty "thing" she sent to the Texas OAG back in 2009 (claiming I was in cahoots with the Asvestas), I have to admit that she should have gotten her day in court regarding her claims against the Asvestas' and their former bankruptcy attorney.  I would have liked to learn the answer to all her allegations regarding the Asvestas' past bankruptcies filed over the years (only as how they affected the WAO).

Looks like she'll never get her day in court...

WAO Bankruptcy Case - Ballot Summary for Debtor's 1st Amended Plan of Reorg - 030612

Yesterday, I submitted another Public Information Request to the Texas OAG to see where we are at with this case.  I'm very disappointed in the OAG as it appears they are not taking the alleged misappropriation of funds (Cryers this time) seriously.  I can only pray that I am wrong and that animals like Okemo, living at In-Sync Exotics, or Andre, living at BCR, receives the money they richly deserve.  What will it take to get the government to actually be proactive and not reactive to illegal misdeeds?
