The Natives Are Getting Restless For Their Money

Bankruptcy Court Case - Objection to Reorganize - Frerich - 062411

Bad Bills Are Dead (AGAIN) Today!

The Senate closed out yesterday and the House today – the bill is DEAD!   Whoo hooo!

From: Representative Lyle Larson

To: kbrunner@...
Sent: Thu, June 30, 2011 1:03:33 PM
Subject: HB 56 and SB 35

Ms. Brunner,

As you may be aware, HB 56 and SB 35 were not added to the special session call by the Governor and were not passed in the special session. Thanks for your input on this issue. We look forward to working with you in the interim.

Best,

Lyle Larson

Dear Rep. Larson:

This is an urgent appeal to adjust both HB 56 and SB 35 to reflect an open date for those organizations wishing to join ASA.

It is critical the ASA membership cut-off date be changed so an interested party (an ASA pending member) wishing to take over the WAO animals currently living at the now defunct Wild Animal Orphanage will not adversely affected.

Approximately 150 animals lives are at stake. Please sir, push the cut off date back for at least 9 months as this matter is currently pending with the Texas Office of the Attorney General and the Texas Western Bankruptcy Court.

If you require additional information, please do not hesitate to contact me at home xxxxxwork xxxxxxxxxxx

Thank you very much for your kind consideration regarding this issue -

Sincerely,

Kristina Brunner

Looks Like Neither the Chicken or the Egg Arrived to Court on Time

Okay, you just know I had to work this pun into the blog--especially after you read the following court documents:

Bankrupcty Court - Porter Poultry & Egg Late Filing

And the court's response to the late filing request?

Bankrupcty Court - Porter Poultry & Egg Filing

If I am reading this correctly, it appears the WAO owes the egg & poultry company over $12k and this debt took place during the end of Nicole Garcia's tenure.

I remember when these purchases took place.  Even though donations were still coming in, it just wasn't enough to sustain all the WAO carnivores.  That was why I recommended the WAO file for bankruptcy (re-organization) and then go out with a mass appeal through the media to help save the WAO animals.  But no.

Sumner said no.

So now, an innocent party is dragged into this bankruptcy mess.  I pray the court eventually does the right thing and ensures this company receives full compensation for the chicken it sold to the WAO in 2010.  For you see, if it wasn't for this company, many of the WAO animals would not be alive today.

Sabu, Can you Hear Me Now?

A few of days ago, Sabu's ear swelled up slightly and it became clear something was wrong as Sabu continuous rubbed his ear against his enclosure.  Concerned, Vicky called in the vet and last night I received a progress report on precious Sabu.

As suspected, Sabu had an ear infection.  The ear was clean thoroughly and Sabu was placed on antibiotics for the infection.  In no time, Sabu should be able to hear Vicky ask him, "Hey Sabu, can you hear me now?"

Needless to say, Sabu had to be lightly sedated so the doctor could perform the exam.  Sedation for Sabu, at his age, is a risk, so all precautions were taken to ensure he recovered quickly from the sedation.

When Sabu recovered from the light sedation, he only wanted lots of love and attention-- he just wasn't interested in taking all his meds.  Who can blame him!  He is such a love bug!

Later:

Well, isn't this interesting... Kovu also had an ear infection per the e-newletter I received on July 1st:

Bless his heart, I hope he is feeling better today!

Carol Asvestas Wants Your Stuff!

Here we go again!  Carol Asvestas placed on her Facebook page that she wants your antiques, figurines, and the like so she can "auction" them off!

Click picture to enlarge

I remember the last time when Carol placed a similar call for other people's stuff in one of the WAO newsletter around 2004.  Sure a lot of people donated great stuff that was supposed to auctioned off at a WAO FunFest that never took place.  Instead, I was told by Linda Howard, back in 2006, that she recognized some of her stuff she gave Carol for the auction--in Carol's house!  So what happened to the donated antique furniture I saw in the WAO office that had been dropped off for the "alleged" auction?  E-Bay?  Craig's List?

I would send this Facebook page to the OAG, but why bother.  I have no doubt Mr. James Anthony from the Charitable Trust Division would simply file this document somewhere too.  After all, why would he care about Carol's new "non-profit animal care facility?"

So, I've decided to keep an eye out on various For Sale websites to see if Carol Avestas starts selling off "donated" items for cash--just for grins.  My guess is Carol wants to hold fundraisers just so she can buy the Leslie Road property for her new "venture."

You know, some things never change.

Remaining WAO Chimps to Leave WAO Soon!

My prayers have been answered -- the last five chimps will finally leave the WAO and relocate to Chimp Haven!

Hearing to Consider and Act Upon the Following: (Related Document(s): 111 Motion to Transfer Chimpanzees to Chimp Haven filed by William R. Davis Jr for Debtor Animal Sanctuary of the United States (Davis, William)) Hearing Scheduled For 8/10/2011 at 09:30 AM at SA Courtroom 1

Asvestas' to Buy the Leslie Road Property?

Well, the bankrupcty court approved the use of a real estate agent to buy the Leslie Road property.

112-2 - Approval to use Century 21 to sell Leslie Road property

Rumor has it that the Avestas' want to buy this property (seeing how they never owned the property in the first place -- wink wink), so Carol Asvestas can rebuild her non-profit empire once again.

And so the cycle of animal "abuse" continues...

A Puzzling Situation!

Who is this beautiful tiger?  The answer is puzzling to me!

Time to Fire the WAO "Bookkeeper?"

Last night the WAO May Operating Report was posted to the on-line Bankrupcty Court files and gee, what a shock, the expenditure ledger was a complete disaster, again.  I may be biased, but it appears to me that the May report was by far, the worst report submitted to the bankruptcy court, year to date.

Let's take a look at the May Operating Report...

WAO Operations Report - May 2011

When one tried to match the incoming revenue versus the expenses, it became clear the reporting cover worksheet did not match the Bank of America's reported transactions.  Why?  Because Meyer included a $25k estate bequest that was signed directly over to the WAO's bankruptcy attorney.  It was never processed though Bank of America as a revenue/expense.

This hidden transaction was not noted until you read the fine print on the last page of the operations report (fax page 16).

Hmmm.  I wonder if it was the intention of the benefactor to pay for the WAO's bankrupcty attorney's fees!  I willing to bet the real intention of the benefactor was to see that the $25k went to animal care, but I could be wrong...

Of course the most glaring error found on the monthly operations report produced by Meyer was all the "NEED RECEIPT" entries found throughout the report (17 missing receipts).  For a bookkeeper, this is simply unacceptable.  Exactly what is the WAO paying this woman for when she cannot even keep tract of the revenue and expenses?

Déjà vu all over again!

Once again, there is an usual amount of trips to Valero, Shell, and Exxon Mobile (13 trips in one month).

Buying toys for the animals at Target's sporting good department?

Buying $140.78 worth of cat food?

Then there's my favorite -- she no idea to whom checks were made out to for check #s 1148, 1150, and 1151 (okay Meyer, what about check #1149?), she did not know when the checks were actually written ("may need to add or change dates on ledger"???), and she did not know what the checks were written for!

I examined the reports more thoroughly and discovered Mike Dereadt apparently no longer works at the WAO.  Last month there were six employees listed on the April report and May's report stated there were only five employees working at the WAO.  As you can see in the report, Dereadt's last paycheck was for the period of 4/28 - 5/4!

I wonder if he was fired or if he left voluntarily...

By the way, did the WAO ever recoup the amount spent "by mistake" at the Sunglasses Hut yet? Exactly whom made this so called "error" anyway?  If payment was made, where is it listed on the report?

In my opinion, the bookkeeper should be fired, as she continually submits sloppy reports to the court.  Cryer should be immensely embarrassed for releasing these horribly inaccurate reports each month--just goes to show she has absolutely no business sense.

It's no wonder the bankruptcy attorney wanted to be paid in full right away, considering there were so many errors discovered in the financial report statements.  Truly, where is the animals' money going?

I wonder if Donald Trump is available to say "you're fired" to a couple more WAO people.

Sabu and Jinxie are In-Sync Together!

I had a great time at In-Sync Exotics!

Here are the details...

I was awaken to the sound of my phone ringing at 4:00am -- you know, it's never good news when someone calls you at 4:00am.  Anyhoo, it was Nicole, calling to let me know that she would be unable to go on the road trip with me.  I was very disappointed, but I do understand the needs of a sick child must come first, so I made the decision to make the five hour journey alone.  At 6:25am I was on the road just as the sun started to crest the horizon.
Starship Pegasus

I couldn't have asked for a better morning to travel.  The only traffic I encountered was near the Austin city limits.

Since I have not traveled outside San Antonio in years, I was  like a kid trying to take in all the scenery at once.  Texas is gorgeous!    I saw so many startling things while speeding by on the highway, like the Starship Pegasus and a modular bug building right next store!  Both these structures were located in Italy--Italy, Texas that is.  Along the way I saw an amazing amount of American and Texas flags flying which made me feel proud to be a Texan!

The drive to In-Sync was beautiful--so many green trees!   I arrived refresh and ready to see Sabu and Jinxie at 11:30am.  It was already in the mid-90's when I arrived, but I was not daunted by the heat!  I was ready to see my two favorite lions...

It was my pleasure to finally meet Vicky in person!  After a brief conversation, we went out to see Jinxie and Sabu!

Jinxie posing for the camera
By the time we reached Jinxie's quarters, I was overcome with emotion.  I missed Jinxie so much and seeing her there, looking really good, made my heart sing for joy.  I was crying, Jinxie was making crying sounds, rubbing up against the enclosure wall, I couldn't believe she still remembered me after all the time that had passed.  It has been over a year since I last saw her and at that time I didn't get to say goodbye to her.  To be honest, I didn't think I'd ever see her again.

After spending time with Jinxie, it was time to be reunited with my favorite boy lion, Sabu.  I turned around and there he was, watching the commotion, curious as to what was going on.  I was able to take a quick snappy of Sabu before he walked over to say hello to us.  Again, lots of tears, tiger rubs, and joy of seeing each other.

Sabu looked so happy in his new home and it was clear he loved all the attention he received from me and Vicky.  It was so hard to watch Sabu walk around with such obvious pain in his hind legs as a result of his the vitamin A deficiency.  God Bless my baby Sabu...

How in the world could the WAO and USDA/APHIS vets allow Sabu to suffer for so long?  Clearly, denying Sabu vet care during his extreme time of need, should have been classified as animal abuse.  I have no doubt that Sabu would have died at Talley Road this summer if Vicky had not taken him in when she did.

Sabu currently takes 16 vitamin A pills per day along with a vitamin shot once per week.  I pray the vitamins will help Sabu maintain his balance and help him walk better as he had a tendency to fall down several times while moving around.

Sabu loving the attention from Vicky
Sabu used to hate going into the transporter at the WAO.  Now he loves his transporter.  After watching him go in and out of the transporter, I realized he loved going into the transporter simply because it put him in the center of the action.  Boy, did Sabu love being the center of attention -- and he did receive a lot of loving from Vicky and staff!

Sabu enjoying a breeze
Needless to say, it was a hot windy day in Dallas (101 degrees with a 105 degree heat index).  The cats however, were nice and cool because each enclosure had a large industrial fan blowing cool air around.  I wish the WAO animals could have received this type of attention to their needs.

I checked out Sabu's neighbors to see how they were dealing with the heat.  Meet Sheila and Kahn, Sabu's newest friends:
Meet Kahn!

Meet Sheila!  She was very shy
We then went back to see Jinxie again as it was time to have her blood drawn for medical testing.  Jinxie was never a big fan of small spaces and needless to say, Jinxie did not want to cooperate today.

You can still see the scar on her shoulder blade where the growth had to be removed, along with the cancerous tumor back in April 2011.  Like Sabu, if Jinxie had not relocated from WAO to In-Sync, she probably would have died from cancer.  Jinxie was determined not to co-operate with Vickie as Jinxie did not want to have her blood drawn!

Instead, she enjoyed laying in the shade as she watched the workers try to come up with a plan to encourage Jinxie into the "shoot" so Vicky could obtain a small sample of her blood.

I think this is Shazam!

Jinxie won this round -- no blood draw today!  She had so much pent of energy, she decided to tease the boys living next to her!  Meet Shazam and Jazz!

I went back to see Sabu again, spending some quality time with the boy before it was time to go.  I couldn't believe how fast time flew by.  After a tearful farewell to Sabu and Jinxie, I went on a tour to meet the rest of In-Sync's residents.

Funny story...while I was watching the tigers being moved around so they could enjoy the play area, I met Lucca, an eleven year old female Bengal tiger.  We hit it off so well that that Lucca decided to spray me not once, not twice, but three times.  She thought she was so cute spraying me over and over again...  Isn't this innocent face simply adorable?

Now that I have been marked by Lucca (several times over) we are now the best of buddies!

I also found Mohan quite the character in the playground pool!

Mohan is a water baby!

I was supposed to depart between 1:30 - 2:00pm.  Not surprisingly, I didn't leave until around 3:15pm.  Despite the long drive (317 miles one way) during rush hour traffic, I am so glad I went to In-Sync.  At first, I was afraid to travel such a distance by myself in the heat.  Thank goodness I over came my fear so I could spend a wonderful afternoon with Vicky and the cats!

With Vicky's approval, I'd like to visit In-Sync twice a year (Spring and Fall) to see the animals.  I can't wait for my next visit this year, preferably when it is much cooler!

I'd also like to thank Vicky for spending four hours with me, showing me around In-Sync and for putting up with all my tears of joy when visiting Sabu and Jinxie.  I will always miss Jinxie and Sabu, but knowing that they are at a place where they receive a lot of love and attention makes me feel so much better.

I arrived home around 8:15pm exhausted and happy that I took the trip to see my favorite lions and make new friends.  Thank you In-Sync Exotics!!

Sabu's Health is Slowly Improving!

I am so happy to see Sabu moving around some more.  It will be awhile before In-Sync learns whether or not the heavy doses of vitamin A will improve Sabu's walking ability.  I think Sabu is making some progress thus far; he probably will not recover fully from what happened to him at the WAO.  All I can pray for his good health.  God Bless Sabu!

The Answers to My Prayers Was "No"

For the last couple of days, I have had the overwhelming feeling that In-Sync Exotics will not be allowed to take receivership of the animals after all.  The longer the OAG delays in responding to In-Sync's proposal, the more I believe the OAG will end up pulling the plug on the plan to save the remaining WAO animals.

I've been praying for some sort of sign as to what to expect from the OAG.  Each time I asked God if there would be a happy ending to the story, I would hear the same song on the radio, over and over again.  The song title is "Beautiful" and it was the song I used to say good-bye to the WAO animals last year.  I know now that the In-Sync will not be able to take receivership of the WAO animals.

I guess I wasn't meant to help save the WAO animals.  I think I was meant to document and record the WAO's demise until its very end.  Some day this story will be told and the animals will not be forgotten.

Later:

It's Friday and I have learned that Hal Morris is on vacation!  Maybe that's why there's been no response to Vicky's proposal.  Perhaps there is a chance In-Sync Exotics will be allowed to care for the remaining WAO animals?

Tomorrow, Nicole and I will be traveling together to In-Sync Exotics to see Sabu and Jinxie!  I am so excited to see them both.  I am also looking forward to meeting Vicky and the sanctuary animals!  Tomorrow cannot come fast enough.  I am packed and ready for the five hour road trip.  I pray Jinxie and Sabu still remember me.  Regardless if they do or not, it still will be great to see them both.

Lulu Moves into Her New Home

Lulu currently lives as Safe Haven Rescue Zoo, located in Nevada.  I'll bet it is just as hot, if not hotter than San Antonio's current temperature of 100 degrees!  Lulu will definitely need a lot of shade and a pool!

Hi Kristina,

We are about a week away from getting Lulu's enclosure finished. We have had some tough weather which is why it is taking so long to get her enclosure finished up. I will be sure to get you all of the pictures and videos that we take.

Here is a picture of IFAW I thought you might enjoy
(Safe Haven attached a photo that was previously sent to me by an Intern many, many weeks ago)

Look, I'm under no illusion that Lynda just "happened" to think of me as Lulu gets closer to moving into her new digs.  I had told Lynda I would send Lulu a ball for her pool, once it was built in her new enclosure.  I believe the above email was Lynda's way of saying politely "hey, where's the free toy."

Never mind Lynda has never provided me a copy of the video showing Lulu, IFAW and Kovu enjoying the boomer balls I sent them last November as previously promised.  So what do you think is the odds that I will receive this one without making another "toy" contribution?  Or even after a toy is supplied?  I'm thinking slim to none.

Later:

Okay, it's been two weeks and no promised pictures or videos.  Hmmm....big surprise.  So I sent a following-up email:

Greetings Lynda:

How did Lulu's relocation to her new home go? By chance is there a video (or two, or three) of the girl's move? Does she have a pool yet? It's been awhile since I've asked, so how are IFAW and Kovu doing? Are the cats still enjoying their Thanksgiving presents?

I'd love to read more about how the cats are doing in Nevada. Is the weather hot there right now? It's been in the 100s here with humidity added in for total discomfort!

I still miss Lulu, IFAW and Kovo and I look forward to seeing more pictures, videos, and anything stories you'd like to share about the three.

Many thanks in advance-

Kind Regards,

Kris
While I wait for a response from Lynda, I thought I'd check Safe Haven's Facebook page for some type of update on Lulu.  I struck gold and it appears Lulu has been living in her new quarters for about a week now.

Lulu lets out a big yawn after a long day.
April 19, 2011
Much later:

Well, it's July 1st and still no response to my June 14 query.  No sense sending another email as I'm sure I'll be ignored once again.  When I sent Safe Haven the boomer balls last year, I thought Safe Haven was different from the WAO, that it wasn't run by a person who was only out for the "freebies" sent to her organization by gullible people.  I trusted she would keep her word to me.  So much for that.

I'm amazed by the wall of silence or lies that sanctuaries put up around their publicly-funded sanctuaries.  If it wasn't for the contributions made by donors, these people would have (1) no one to support their private pets come rescued animals;  and (2) no job, hence no income.  Why sanctuary directors take for granted the donor "gifts" provided to the sanctuary is beyond me.  It's a shame there isn't more outreach to the people who want to help the sanctuary, considering they are the ones footing the bills!

Where's the transparency?  Where's the honesty?  Should donors expect less from their publicly funded sanctuaries?

A Proposal to Save the WAO Animals

For the last several weeks, Vicky (In-Sync Exotics) and I have been discussing the plight of the WAO animals.  Based on all the court records, I have a feeling time is running out for the 25 tigers, 100+macaques and four wolf dogs.

Vicky, wanting to save the animals, contacted GFAS and the Texas OAG to let them know In-Sync Exotics was willing to assume receivership of the animals and the WAO's remaining assets.  This was done prior to taking in Sabu.

For weeks, there was no news of In-Sync's proposal until last week (June 2nd)!

GFAS' Patty Finch called In-Sync Exotics to let Vicky know that GFAS would like for Vicky to submit an "expectations" letter (essentially detailing what In-Sync would need to make the receivership work).  Apparently the OAG wants to have an agreement in place before the end of the month.

Well, the "expectation" letter was sent and now we wait to see what GFAS and the Texas OAG says about this proposed plan.  I truly pray this works out for I am hearing through the grapevine that many of the WAO tigers are thin and the hot weather is taking its toll on all the animals.  I believe many of the older tigers will probably have Vitamin A deficiency as well.

Something must be done very soon to save the animals!  I pray the OAG attorney, James Anthony, does not mess this up for the WAO animals.

I received this email message from another person who is watching the Bills very closely:

Not to worry. There are only certain items that can be brought to the floor for the Governor to hear and the wild animal bill is not one of them. They can only discuss education, health care, and there are a couple of others that the Governor approved for legislation discussion. The ONLY way the wild animal bill could make it to the floor is IF it is attached to another bill, which at that point, Rep. Laubenberg is prepared to make a point of order stating that the wild animal bill does not apply to the approved legislation. The only reason the bill was heard in committee is because Larson is on the committee and he must have talked his Chairman into hearing it. It is very odd that a bill would be brought to committee when it cannot be heard on the floor because of restrictions on items that can be heard/discussed/voted on.
I pray this is true for the WAO animals' sake.

Here's another response received regarding the action taken on 6.14.11:
Praying still!
Been watching as well....and in contact with our Rep's office.   They are "swearing" that this is routine,..and Larson is just making a big push to get Perry's attention. But they are saying unless Perry gives it the go ahead, its just wasting everyone's time.  If the House and Senate get all the mess they are working on done first,..then Perry "might",...(very slim chance I am told), he would allow it.  Might be a good idea and get your Rep's thoughts as well,...  But everyone here is staying Larson is just wasting time,..

Unexpected Developments from the Bankruptcy Court

I thought for sure this would be a slow month for the WAO and Bankruptcy Court.  I was wrong:

Objection to the Second Motijon of Asus to Extend Chapt 11 Plan of Reorg

From what I have been able to learn from my Texas OAG open records request, the "big" animal organization declined not to assume possession of the WAO.  So now what?

And there's more bad news for the WAO:

Motion of Jefferson Bank for Relief From Stay

Sworn Affidavit by Jefferson State Bank Employee

Exhibits to Jefferson State Banks Motion to Stay

Cryer signed all the loan paperwork, so it begs the question, did her self-appointed "board" know Cryer intended to put up all the WAO vehicles up for collateral, with absolutely no plan to raise the necessary funds to pay off the balance, resulting in the WAO losing most of its expensive assets?  Now that would be an interesting board meeting minutes I would like to see--how about you?

Later:  This notice was posted to the docket:
Hearing to Consider and Act Upon the Following: (Related Document(s): 102 Motion for Relief from Stay (14 Day Objection Language) ( Filing Fee: $ 150.00 ) filed by Richard E. Hettinger for Creditor Jefferson Bank (Attachments: # 1 Affidavit Exhibit A# 2 Exhibit Exhibits 1 - 5)(Hettinger, Richard)) Hearing Scheduled For 7/5/2011 at 02:00 PM at SA Courtroom 1 (Elizondo, Lisa)

Looks like the WAO is trying to keep Jefferson State Bank from seizing its assets which was used as collateral to secure a loan made by Cryer last year:

Sabu's Blood Test Results Are In

I learned on Sunday that Sabu's blood work came back and not surprisingly, he was vitamin A deficient.  According to Vicky, Sabu's vitamin A level in his blood should have been closer to 200.  Sabu's level came in at 16.

Heartbreaking news, but not unexpected.

For the next three months, Sabu must take 16 pills a day for his vitamin A deficiency (400,000 IU), along with two other types of medication to ease his painful joints.  I pray the vitamin A deficiency will be corrected right away so he can run and play like he used to.

God Bless Sabu for all that he has been through over the last six years.
